Terms of service

These terms apply when you use the CLOTH store and order a case from us. CLOTH is run by Bunker Fox Labs, based in North Carolina, USA (“we”, “us”). By placing an order you agree to these terms, our returns & cancellations policy and our privacy policy.

1. Custom cases

Every case is made to order from the image you upload and the phone model, case type and finish you choose. The flat template and 3D view in the designer show how your case will look, but they're a guide: colours on a screen, the way the print wraps around the edges, and small details can look a little different on the finished case. Please check that you've chosen the right phone model before you order.

You need to be 18 or over, or have a parent or guardian's permission, to place an order.

2. Your images

When you upload an image, you confirm that:

• you own it, or have permission from whoever does to print it on a case;
• printing it doesn't break the law or anyone else's rights, including copyright, trademarks, privacy and publicity rights;
• it isn't hateful, harassing, violent, sexually explicit or otherwise unlawful.

You keep ownership of your image. You give us, and the partner that prints and ships your case, permission to store, copy and print it, only to make, ship and support your order and to keep our records.

We may refuse or cancel an order whose image we believe breaks these rules, and refund it in full. If someone makes a claim against us because of an image you uploaded, you agree to cover our reasonable costs of dealing with it, as far as the law allows.

3. Prices and payment

Prices are in US dollars and are shown, with shipping, before you pay. Payment is taken when you place your order and is processed by Stripe; we never see or store your full card details. Depending on where you live, your country may charge import duties or taxes on delivery. Those are yours to pay unless they were included at checkout.

4. Your order

We confirm your order by email. We may cancel an order before it's made, for example if a price was wrong, an image breaks section 2, or we can't deliver to your address, and we'll refund you in full if we do.

Once the 6-hour cancellation window has passed, your case can go into production at any time. Delivery times we give are estimates, not guarantees. We ship to the address you give at checkout, so please check it.

5. Cancellations, returns and warranty

You can cancel within 6 hours of ordering. Because cases are personalised, we don't take returns or exchanges, but we refund a case that arrives with a problem with the print or the case, and every case has a 1-year warranty against defects. The details are in our returns & cancellations policy, which is part of these terms.

6. Using the store

The store, its design and its content belong to us. Please don't misuse it: don't try to break or overload it, get into parts you aren't meant to, upload anything harmful, or copy it in bulk.

7. Our responsibility to you

A case protects your phone in everyday use, but it can't guarantee that your phone won't be damaged. As far as the law allows, we aren't responsible for damage to your phone, or for losses we couldn't reasonably have foreseen, and our total responsibility for an order is limited to the amount you paid for it.

Nothing in these terms limits responsibility that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud, and nothing here takes away your rights under the consumer law of the country you live in.

8. Changes to these terms

We may update these terms from time to time; the date at the top shows when they last changed. The terms on the site when you place an order are the ones that apply to that order.

9. Law

These terms are governed by the laws of the State of North Carolina, USA, and disputes about them can be brought in the state or federal courts in North Carolina. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in its courts instead.
